Solomon Amendment

The Solomon Amendment (10 U.S.C. § 983) requires institutions to provide Department of Defense representatives access to student recruitment information on students age 17 and older. The Education Department has determined that the Solomon Amendment supersedes most elements of the Family Educational Rights and Privacy Act (FERPA). An institution receiving funding from a federal agency is required to fulfill military recruitment requests for lists containing student information.

Student Recruitment Information

Student recruiting information refers to the information that military recruiters may request and receive about students. Recruiters may receive student recruiting information for either the previous, current or future term for all students, aged 17 and older. The Solomon Amendment provides that students included in student lists must have or are currently enrolled for at least one credit to be provided.  Nassau Community College can provide the following in accordance with the Final Regulations:

  • Name
  • Address
  • Email Address
  • Telephone 
  • Age
  • Class Level
  • Academic Program
  • Degrees Received

The College is prohibited from providing the following under the Solomon Amendment per the Amendment and the Family Education Rights and Privacy Act (FERPA): 

  • Social Security Numbers
  • Race/ethnicity/nationality
  • Grades
  • GPA
  • Loan status (including default)
  • Veteran status
  • Religious affiliation
  • Former Students, graduates, or individuals no longer enrolled

Procedures for Requesting Information

  • All requests for information must be submitted using the Solomon Amendment Data Request Form.
  • Information will be released for military recruitment purposes only.
  • Military recruiters from the five major branches of armed services (Army, Navy, Marine Corps, Air Force, and Coast Guard) and any ROTC unit of an armed services branch may request student recruitment information once each semester.
  • The request must be submitted in writing on letterhead that clearly identifies the unit of service requesting the student recruitment information.
  • The request must specify whether the information is for a current or previous semester.
  • The Registrar’s staff will confirm if the request aligns with what is allowed to be released.
  • The Registrar will not release information for students who have FERPA holds on their student record.
  • The Registrar’s staff may send a response email indicating the request has been received and provide a reasonable timeframe for a response.
  • Please allow at least two (2) weeks for the request to be reviewed and completed.
  • Data will be provided via secured link sent to the requestor. Only the requestor will be able to access this file.
