ORDINANCE NO. 89 - 2007AMENDING ORDINANCE NO. 238 – 1984, AS AMENDED BY ORDINANCE
152 -1993 ENTITLED “ESTABLISHING RULES AND REGULATIONS RELATING TO THE USE OF CERTAIN
COUNTY-OWNED AND/OR OPERATED FACILITIES.”BE IT ORDAINED by the County Legislature
of Nassau County, as follows:
Section 1. Section 4 of Ordinance 238 – 1984, as amended by Ordinance 152 – 1993 is hereby amended
as follows:
“m. Skateboards and Rollerblades. With respect only to Nassau Community College, no
person, with or without wearing a helmet, shall operate a skateboard, as defined as
a manufactured or assembled device consisting of a platform having two or more small
wheels mounted or permanently attached thereto which is used for skating or gliding,
or use rollerblades within campus buildings, on campus stairs, on campus benches or
other structures upon which seating is possible, on campus railings or banisters,
on campus walls, on campus sidewalks or on campus ramps.”
Section 2. Within thirty (30) days of the enactment of this ordinance, Nassau Community College
shall provide notice as to the prohibitions contained within said ordinance. Such
notice shall be implemented by: a) the posting of signs at the entrances to Nassau
Community College, b) the posting of signs at those locations within the Nassau Community
College campus at which activity to be covered by this ordinance has frequently occurred,
and c) the posting on internet sites which it is reasonable to assume that individuals
likely to engage in such activity may view.
Section 3. Within one year from the date of enactment of this ordinance, Nassau Community College
shall report to the Presiding Officer and Minority Leader of the Nassau County Legislature
and to the chair and ranking member of the Public Safety Committee as to the impact
of this ordinance on the behavior to be regulated by it and shall make any appropriate
recommendations on how to enhance the effectiveness of this ordinance with respect
to such regulation.
Section 4. Section 6 of Ordinance 238-1984, as amended by Ordinance 152-1993 is hereby amended
as follows:
“Penalties. A violation of the provisions of this ordinance shall be punishable by
a fine not exceeding one thousand dollars or imprisonment for a period of not more
than one year or by both such fine and imprisonment, provided, however, that the maximum
penalty for a violation of section 4(m) of this ordinance dealing with skateboarding
and rollerblading in certain areas of the campus of Nassau Community College shall
not exceed three hundred-fifty dollars ($350) for the first offense.”
Section 5. This ordinance shall take effect immediately upon the receipt of a report from Nassau
Community College by the County Executive, the Presiding Officer and the Minority
Leader of the County Legislature and the Chair and the ranking member of the Public
Safety Committee of the Nassau County Legislature that the notice required under Section
2 of this ordinance has been implemented by the College.
SUMMARY OF PROVISIONS:
This ordinance provides that no person, with or without a helmet, shall operate a
skateboard, as defined as a manufactured or assembled device consisting of a platform
having two or more small wheels mounted or permanently attached to it, nor shall use
rollerblades in the following locations within the boundaries of the College campus:
within campus buildings, on campus stairs, on campus benches or other structures upon
which seating is possible, on campus railings or banisters, on campus walls, on campus
sidewalks or on campus ramps. The penalty for the violation of this ordinance shall
be the same as for the violation of Ordinance 238-1984, as amended by Ordinance 152-1993,
which established a maximum fine of one thousand dollars or imprisonment for a period
of not more than one year (or both), provided, however, that the maximum penalty for
a violation of this ordinance shall not exceed three hundred-fifty dollars ($350)
for the first offense.
